In accordance with Article R211.4 of the French Tourism Code, these Special Terms and Conditions of Sale are intended to inform clients of the Bonifacio Municipal Tourist Office (OMT) of the information provided for in the aforementioned article, prior to the signing of the contract. In accordance with Article L211.9 of the Tourism Code, this pre-contractual information shall form an integral part of the contract and may only be amended by means of an expressly agreed arrangement between the parties.
These Special Terms and Conditions of Sale may be amended and updated by the OMT at any time. The applicable information forms and Special Terms and Conditions of Sale in force at the time of registration shall apply. These Special Terms and Conditions of Sale are provided to the client at the time of booking a service with the OMT and can be viewed and downloaded from the website: https://booking.bonifacio.co.uk/
1. Establishment of the contract
1-1 Booking any of the tourist services (accommodation, transport, packages, guided tours, ticketing, etc.) offered by the OMT constitutes unconditional acceptance of the provisions of our Special Terms and Conditions of Sale.
1-2 Bookings for the services (ticketing, activities, guided tours, accommodation, etc.) offered by the OMT may be made:
- either at the Tourist Office reception,
- or by email to reservation@bonifacio.fr,
- or via the website: https://booking.bonifacio.co.uk/
1-3 The booking of a custom package including accommodation and/or transport and/or activities is made exclusively through the reservations service: reservation@bonifacio.fr – +33 (0)4 95 72 18 22
Any order will only be considered final:
- on the one hand, upon receipt of the completed, dated and signed travel contract by post or email, subject to confirmation by the OMT in view of technical feasibility, availability of places and the minimum number of participants. The provisions of the aforementioned contract take precedence over those set out in these Special Terms and Conditions of Sale, without prejudice to the applicable legislation.
- and, on the other hand, upon receipt of the balance for all bookings made less than 30 days before the start of the service, or a deposit of 30% of the total amount of the services in all other cases.
2. Terms and conditions for the provision of services
For all services sold by the OMT, given their time-specific nature, they may under no circumstances be extended beyond the time frame of the service. The client must arrive on the specified day and at the specified time, or contact the service provider directly.
2.1 – For stays including accommodation: packages, bundles or custom trips
Accommodation services are calculated by the number of nights, whether included in a package or not. The price includes room rental with or without breakfast, or half board, or full board. The services or benefits included in the package are specified on the product sheet on our website or in our brochures for each of the services. Unless otherwise contractually stipulated, they do not include drinks with meals or any other possible supplements. When a client occupies a room intended for two people alone, a charge known as the “single room supplement” will be applied. For accommodation bookings, we strongly advise you to inform the hotelier of your expected arrival time directly, as some hotels do not have a night reception.
2.2 – For ticketing
For purchases made on the website https://booking.bonifacio.co.uk/, tickets are sent by email to the email address used for the purchase.
2.3 – For the booking of guided tours
Each participant must arrive at the meeting point indicated on the ticket, 10 minutes before the start of the tour. In the event of late arrival, the guide will commence the tour at the scheduled time and the service will remain due and will not be eligible for any refund.
Guided tours may be cancelled in the event of adverse weather conditions or in cases of force majeure (prefectural order, guide illness or accident). In such cases, the amount paid will be refunded to you, without any entitlement to compensation. Each participant must comply with the health and safety regulations and follow the guide's instructions throughout the tour. Children remain the sole responsibility of their parents. As the tours take place on foot, participants are advised to wear appropriate shoes and clothing for the weather.
2.4 - For the booking of various excursions or leisure activities
The specified times must be respected in order to ensure the proper conduct of the service.
In the event of a late arrival and without any notification from the client regarding their arrival time, the reservation is guaranteed at the discretion of the service provider. It is advisable to arrive 10 minutes before the start of the activity.
If the provider has an obligation not to wait for late clients, no refund may be requested.
It may occur that certain activities, indicated in the description, or the entirety of the service offered by the providers are cancelled due to adverse weather conditions: in such cases, clients will be offered either a full refund or an equivalent service at a later date. Meals and drinks are not included in the services, unless explicitly stated on the ticket.
3. No right of withdrawal
The 14-day right of withdrawal does not apply to accommodation, catering, or leisure services (ticketing, guided tours, etc.) that are provided on a specific date or during a specified period, in accordance with Article L221-28, 12° of the French Consumer Code.
4. Prices
4-1 All prices are displayed in euros and include VAT, or apply VAT according to the special scheme for travel agencies, or are exclusive of VAT.
4-2 Unless otherwise specified in the description of a service confirmed in the contract, the following are not included in the price: personal expenses, insurance, optional or additional services not included in the description of the service, tourist tax and additional tourist tax.
5. Payment
5-1 Any registration requires payment in full of the service, or a deposit, with the balance due 30 days before the start of the service, depending on the type of service subscribed to as indicated in our materials and on the contract.
5-2 Payment can be made as follows:
- In cash: at the OMT offices,
- By bank or postal cheque: made payable to Régie de Recettes OMT Bonifacio (proof of identity will be required),
- By bank card: at the OMT offices or via our online booking service at https://booking.bonifacio.co.uk/
- By holiday vouchers (only at the OMT offices): payment can be made by holiday vouchers, either in part or in full. No change will be given for holiday vouchers.
- By bank transfer: the reservations department will provide the bank details.
6. Modification by the client
6-1 Leisure activities, tourist products and services, catering services, standalone or in a package
All requests for modification prior to the start of the service must be sent strictly by email to reservation@bonifacio.fr. Any modification is subject to the prior agreement of the OMT. As each request is handled on an individual basis, the OMT is available to the client to review any contractual modifications or requests for additional services.
6-2 Packages with transport and accommodation
Packages are subject to non-modifiable and non-refundable conditions. This means that all bookings are final and cannot be modified or cancelled, whether for transport, accommodation, or both. No refund will be granted, regardless of the reason for cancellation or modification.
7. Modification by the OMT
7-1 In accordance with Article L211-13 of the Tourism Code, the OMT may, prior to the start of the service, unilaterally modify the contractual terms other than the price, in accordance with Article L211-12 of the Tourism Code, under the conditions and according to the procedures set out in Article L211-13 of the Tourism Code. The modification must be minor and the OMT must inform the client in a clear, comprehensible and prominent manner on a durable medium of:
- The proposed modifications and, where applicable, their impact on the price of the service,
- The reasonable period within which they must communicate their decision to the OMT,
- The consequences of failing to respond within the specified period,
- Where applicable, the alternative service offered, as well as its price.
7-2 Where modifications to the contract or the substitute service result in a reduction in the quality of the trip or stay, or in its cost, the client is entitled to an appropriate price reduction.
7-3 If the contract is terminated and the client does not accept an alternative service, the OMT shall reimburse all payments made by the client as soon as possible and, in any case, no later than fourteen days after termination of the contract, without prejudice to any compensation in accordance with Article L211-17 of the Tourism Code.
8. Cancellation by the client
In accordance with Article L211-14, I of the Tourism Code, the client may terminate the contract at any time prior to the start of the service, subject to compliance with the following procedure and refund conditions:
Any partial or total cancellation must be notified by email to reservation@bonifacio.fr, or by registered letter with acknowledgement of receipt to Office Municipal de Tourisme de Bonifacio – Service Réservation – 2 Rue Fred Scamaroni – 20169 Bonifacio.
8-1 Standalone or package accommodation services
In the event of total or partial cancellation by the individual client, by a group, or by an individual within a group (the time taken into account is set at 12:00 pm on the scheduled day of arrival), the termination / cancellation fees are set as follows:

The cancellation fees (according to the conditions) may be covered by taking out cancellation or multi-risk insurance with our partner Gritchen Affinity, or with another insurer of your choice. The client shall not be entitled to any compensation or refund from the OMT if they shorten or interrupt their stay for any reason whatsoever. Any unused service will not be refunded.
8-2 Leisure activities, tourist products and services, catering services, standalone or in a package
Admission tickets, access passes, vouchers, and all documents issued for leisure activities, tourism products and services, as well as standalone or package catering services, are not subject to any refund, return, or exchange at the client's request. This rule applies under all circumstances, including in the event of loss or theft of the ticket, interruption of the service by the client, the client's failure to appear at the place of the service, personal impediment, change of mind, adverse weather conditions or force majeure affecting the client. The ticket holder assumes full responsibility for the safekeeping of their ticket. The OMT cannot be held liable in the event of loss, theft, deterioration or destruction of the ticket.
8-3 Packages with transport and accommodation
Packages are subject to non-modifiable and non-refundable conditions. This means that all bookings are final and cannot be modified or cancelled, whether for transport, accommodation, or both. No refund will be granted, regardless of the reason for cancellation or modification.
9. Cancellation by the OMT or a partner
In accordance with Article L. 211-14, III of the Tourism Code, the OMT may terminate the contract and fully reimburse the client for any payments made, without any further compensation being due, if:
The number of participants registered for the tourist service or package is lower than the minimum number specified in the contract, and the OMT notifies the client of the termination of the contract within the period set out in the contract, and at the latest:
- 20 days before the start of the service if its duration exceeds 6 days,
- 7 days before the start of the service if its duration is between 2 and 6 days,
- 48 hours before the start of the service if its duration is less than 2 days.
10. Carrier liability
With respect to travellers, the carriers included in the OMT's offers retain the responsibilities specific to their activities as set out in the statutes governing them, their national legislation, or international conventions which, among other provisions, establish a limitation of such responsibilities.
The OMT cannot have its liability substituted for that of the carriers responsible for passenger transfers or transport. Transport schedules are provided for information purposes only; it is mandatory to confirm your return 72 hours before your departure with the relevant company or their local representative.
11. Refund for cancellation
In the event of cancellation and in accordance with the provisions of Article R221-10 of the Tourism Code, the OMT shall proceed with the reimbursements required under II and III of Article L211-14 or, pursuant to I of Article L. 211-14, of all payments made by the traveller or on their behalf, less the applicable termination fees. These refunds to the traveller shall be made as soon as possible and, in any event, no later than fourteen days after termination of the contract.
12. Late arrival / exceeding the scheduled time
When a service specifies a precise time and place for the start of the service, in the event of late arrival by the client, the client must inform the OMT as soon as possible by telephone on +33 (0)4 95 72 18 22. Services not used due to this late arrival will remain payable and cannot give rise to any refund.
13. Transfer of the contract by the client
In accordance with Articles L211-11 and R211-7 of the Tourism Code, the client may transfer their contract to an assignee who meets the same conditions as themselves to carry out the service. In this case, the client is required to inform the OMT of their decision by email, no later than 7 days before the start of the service.
The transfer of the contract must be carried out at cost price. The transferor and the transferee are jointly liable to the seller for payment of the balance of the price, as well as for any additional costs that may arise from this transfer.
14. Liability
14-1 The OMT is the sole point of contact for the client and is answerable to the client for the performance of the services ordered and for fulfilling the obligations arising from these Special Terms and Conditions of Sale. It is fully liable by law for the performance of the services specified in the contract, whether these services are provided by itself or by other service providers, and is required to assist the client in difficulty.
14-2 The OMT cannot be held liable for booking errors attributable to the client or caused by exceptional and unavoidable circumstances, for the total or partial non-performance of the services ordered in cases of force majeure, due to a third party, to improper performance of its obligations by the client, or in the event of fault on the part of the client.
14-3 The client shall inform the OMT, as soon as reasonably possible in view of the circumstances, of any non-conformity observed during the performance of a travel service included in the contract. The OMT cannot be held liable for any damages of any kind that may result from temporary unavailability of the website or from an interruption of the client’s connection during the booking or payment process.
14-4 If one of the travel services is not performed in accordance with the contract, the OMT shall remedy the non-compliance, unless this is impossible or would incur disproportionate costs, taking into account the significance of the non-compliance and the value of the travel services concerned.
14-5 If the OMT does not remedy the non-conformity within the reasonable period set by the client, the client may remedy it themselves and claim reimbursement of the necessary expenses.
14-6 The experience-based offers proposed by the OMT benefit from the support of the Coursica Tourism Agency (ATC), particularly with regard to the funding of certain equipment necessary for their implementation. This institutional support does not entail any liability on the part of the ATC in the organisation, management, execution or marketing of the aforementioned offers, which remain the sole responsibility of their organisers.
15. Photographs
The descriptions and photographs of the services listed by the Tourist Office, appearing on the website or in brochures, are provided for information purposes only and are the sole responsibility of the service provider. The photographs shown on the website or in our brochures are not contractually binding. Even though every effort is made to ensure that the photographs, graphic representations and texts used to illustrate the service providers give an overview that is as accurate as possible of the services offered, variations may occur. The client may not make any claim on this basis.
16. Personal data protection (GDPR)
The OMT may collect personal data necessary for the electronic processing of your registration, its follow-up, the sending of newsletters, promotional offers, and a satisfaction survey following your stay (via email, SMS messages, telephone calls and postal mail). You may unsubscribe at any time by sending an email to reservation@bonifacio.fr or by sending a letter to the Office Municipal de Tourisme de Bonifacio - Reservation Service – 2 Rue Fred Scamaroni – 20169 Bonifacio, providing proof of your identity.
In accordance with the GDPR, you have the right to access, rectify, update, transfer and delete your personal data. 17. Insurance – Guarantee
The OMT has taken out travel organiser civil liability insurance no. 077779/S with SMACL Assurances in order to cover the consequences of professional civil liability.
The OMT is registered in the Register of Travel Operators with Atout France, under number: IM02A190002 and has taken out a financial guarantee with APST (Association Professionnelle de Solidarité du Tourisme).
18. Force majeure
18-1 Force majeure is defined as any event external to the parties, both unforeseeable and unavoidable, which prevents either the client, the travellers, the agency or the service providers involved in the execution of the trip, from fulfilling one or more of the obligations set out in the contract, or from performing all or part of the agreed services. The following cases are considered as force majeure: earthquake, fire, flood, natural disaster, acts of terrorism, war, civil unrest, riots, closure of establishments, and geographical factors or any other reason beyond its reasonable control. Strikes do not constitute a case of force majeure and therefore cannot give rise to any refund or postponement.
18-2 The occurrence of a force majeure event suspends the obligations under these terms that are affected by it and exempts from all liability the party that should have performed the obligation thus affected. The service provider reserves the right to cancel any booking in the event of force majeure and to change the date. If the service provider is obliged to cancel the service before the client has been able to begin the activity, a postponement of the activity will be offered.
19. Complaint / Dispute
Any complaint relating to a service must be submitted in writing to the OMT within 7 days following the date the service was provided, by email reservation@bonifacio.fr or to the following address: Office Municipal de Tourisme de Bonifacio – Service Réservation – 2 Rue Fred Scamaroni – 20169 Bonifacio.
After having contacted the Tourist Office and in the absence of a satisfactory response within 60 days, or if the response received is not satisfactory, the client may refer the matter to the Tourism and Travel Mediator (www.mtv.travel).
If the sale was made online, the client has the option to use the platform available at https://webgate.ec.europa.eu/odr to resolve their dispute.
In the event of a complaint, the parties shall endeavour to reach an amicable agreement. In the event of a persistent dispute, the Judicial Tribunal of Ajaccio has jurisdiction for legal entities, and in the case of a natural person, jurisdiction is assigned to the competent court in accordance with Article L141-5 of the Consumer Code.
